BNSF requests STB to review merger terms


On 1 December 2025 BNSF Railway filed a petition with the Surface Transportation Board (STB) seeking the enforcement and review of terms from the 1996 merger between Union Pacific (UP) and Southern Pacific (SP). BNSF alleges that UP engaged in obstructive behaviour that diminished competition and harmed customers, despite the STB's conditions meant to protect shippers.

The urgency of BNSF's petition is heightened by UP's recent proposal for a merger with Norfolk Southern. BNSF's request calls for the STB to review the implementation of the UP/SP merger conditions, enforce competitive access rights for BNSF and modify conditions as needed to protect public interests. BNSF underscores the necessity of fair competition for reliable service and reasonable rates, emphasising that these concerns must be addressed before any new merger reshapes the industry and affects the wider supply chain.
